Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of DevWise, a developer platform that combines Git hosting and project/issue tracking (the “Service”). The Service is operated by Björn Sieckmann and Leon Liechti (“DevWise”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are using the Service during the closed alpha, the Pre-Alpha Notice you accepted also applies and prevails where it conflicts with these Terms.
1. The Service
DevWise lets you host Git repositories and manage work through projects, repositories, and tracks. Features are opinionated and may change. During the early-access period the Service is provided for evaluation and is not intended for production-critical workloads.
2. Accounts
You must provide accurate information and keep your credentials, access tokens, and SSH keys secure. You are responsible for all activity under your account. You must be at least 16 years old to use the Service. Notify us promptly of any unauthorized use.
3. Acceptable use
You agree not to use the Service to: violate any law or third-party right; upload or distribute malware or unlawful, infringing, or abusive content; attempt to gain unauthorized access to systems or data; disrupt or overload the Service or circumvent rate limits or access controls; or use it to harass others. Authorized security testing is welcome — please coordinate with us first at [email protected].
4. Your content
You retain all ownership of the code, text, and other content you submit (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, and transmit Your Content solely to operate, secure, and improve the Service. You represent that you have the rights necessary to submit Your Content and to grant this license, and you are solely responsible for it.
5. Public repositories and projects
Content you mark as public is visible to anyone, can be viewed, cloned, and forked, and may be cached or copied by third parties. Make content public only if you intend it to be openly accessible. Visibility cascades one way: a repository can never be more public than the project that contains it.
6. Intellectual property
The Service itself — including its software, design, and the DevWise name and marks — is owned by us and protected by law. These Terms grant you no rights in our intellectual property other than the limited right to use the Service. We welcome feedback and may use it without restriction or obligation to you.
7. Fees
The Service is free to use during the early-access period. We may introduce paid plans in the future; we will give notice before any charges apply to you.
8. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, including for violation of these Terms or to protect the Service or other users. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — will survive.
9. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that data will be preserved. You are responsible for keeping your own backups.
10. Limitation of liability
To the maximum extent permitted by law, DevWise and its operators will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us for it in the twelve months before the claim, which during the early-access period is zero.
11. Indemnification
You agree to indemnify and hold harmless DevWise and its operators from any claims, damages, and expenses arising out of Your Content or your use of the Service in violation of these Terms or applicable law.
12. Changes
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of Switzerland, without regard to its conflict-of-laws rules. The courts of Switzerland have jurisdiction over any dispute, subject to any mandatory consumer protections that apply to you.
